Domestic Violence
Unfortunately, domestic violence effects thousands of victims, on a daily basis.
Fam.C. § 6218 and Fam.C. § 6300, set forth the guidelines for specified protective orders and other domestic violence prevention orders may issue in a domestic relations status action or independently under the Domestic Violence Prevention Act.
Domestic Violence Orders typically require a showing of abuse. Abuse has a legal definition defined as:
• intentionally or recklessly causing or attempting to cause bodily injury; or
• sexual assault; or
• placing a person in “reasonable apprehension” of imminent serious bodily injury to that person or another ; or
• engaging in any behavior that has been or could be enjoined to any of the above.
In many instances, a victim of Domestic Violence should call 911 immediately and then seek court intervention in the way of a Restraining Order.
